Highmark Seeks Stay to Discuss Settlement (9.14.04)
Kreindler & Associates, represents relator Elizabeth Drescher in the qui tam litigation that is pending in the Eastern District of Pennsylvania.
A federal judge has granted Highmark, Inc.'s request for a 60-day stay of discovery in the qui tam litigation pending against it in order to pursue settlement negotiations. Judge Anita Brody's order comes in response to a joint motion by Highmark and the government requesting the stay.
In the False Claims Act case, relator Elizabeth Drescher alleges that Highmark mishandled the application of Medicare as Secondary Payer (MSP) regulations to the detriment of the government and health plan participants. An internal analysis conservatively estimated Highmark's liability to the government to be at least $20 million.
